The Penalties for DWI with Injury in Texas

DWI with injury occurs when an intoxicated driver causes an auto accident which results in serious bodily injury to a passenger or other driver. Serious bodily injury is defined as injury which may be life threatening, or long-term injury to the organs or members of a person's body. A DWI with injury conviction may result in the following penalties:

  • Up to 10 years in prison
  • Fines of up to $10,000
  • Community service of up to 600 hours
  • Driver's license suspension

In order to obtain a conviction, it must be proven that the defendant:

  • Caused the accident
  • The accident caused serious bodily injury
  • The driver was intoxicated

"Intoxicated" may mean that the driver's blood alcohol concentration was .08% or greater, or that his/her abilities were impaired by use of alcohol or drugs.
