How to Get an Occupational Driver's License in Texas

Did you lose your license for DWI? Our firm may be able to help!

Even if you have been convicted of DWI and your license has been suspended, Montgomery County attorney Doug Atkinson may be able to help you. An occupational driver’s license will give a driver restricted driving privileges even after his/her license has been suspended or revoked. An occupational license will enable the driver to drive for occupational and educational purposes, and for essential household needs.

Obtaining an occupational driver’s license may be complex and must be handled in such a way as to offer an individual the best chance of actually getting his/her petition approved first by the court and then have his/her request processed and approved by the Texas Department of Public Safety. Having an experienced lawyer on one’s side will only serve to help ensure that his/her case is handled quickly and properly, through the correct channels, so as to result in an occupational license successfully obtained. Douglas Atkinson understands how to help clients obtain a restricted license and therefore be able to drive for necessary reasons.

The Process of Securing a Restricted Driver's License

To obtain an occupational license in Montgomery County, there are a number of steps that must be carried out. If you work with attorney Atkinson, he can handle these competently and quickly. First, attorney Atkinson must file a petition with the county or district court regarding obtaining your occupational license. A hearing will then be held, in front of a judge, at which time he/she will make a ruling regarding whether to grant your request.

Having Doug Atkinson at your side will help your chances of reaching a favorable outcome at this hearing. After obtaining a court order granting your occupational license, attorney Atkinson will then need to file specific information with the Department of Public Safety (DPS) which is the department responsible for reinstating driving privileges. The information attorney Atkinson will need to file is as follows:

  • A certified copy of the petition to the court
  • A certified copy of the court order granting the occupational license
  • A certificate showing proof of insurance (form SR-22)
  • Payment of an occupational license fee, as well as any other fees required
